Trout Creek business resolves underground storage tank violations

Helena — The Montana Department of Environmental Quality (DEQ) has settled its administrative enforcement action against Mary Kendziorski for violations of the Montana Underground Storage Tank Act at Henry's Hideaway in Trout Creek, Montana.

The Underground Storage Tank Act requires that an tank system owner or operator must conduct monthly leak detection monitoring and maintain monthly monitoring records for a period of 12 months. An inspection conducted in December 2007 at Henry's Hideaway discovered that monthly leak detection records were not available for 11 of the previous 12 months.

The DEQ issued an administrative penalty order in December 2008 to address the violations. Ms. Kendziorski complied with the order by maintaining 12 months of monthly leak detection records, by obtaining a follow-up inspection, and by paying the $604 assessed penalty.

DEQ reminds underground storage tank owners that for systems with automatic leak detection systems, the monthly leak detection report must be printed and maintained on site for a period of 12 months.  For additional information on UST operating permit requirements, contact the UST Program at (406) 444-5300 or visit its web site at: http://www.deq.mt.gov/UST/ustPermitting.asp.
