No charges filed in shooting

The Mineral County Sheriff’s Department has finally released more details about the shooting that occurred back on December 12, 2010, in DeBorgia which claimed the life of Jack Finley.

When officers arrived on scene after responding to a call of a domestic disturbance, they found Finley dead from an apparent gunshot wound to the chest. At the time they arrived, Finley’s wife, Mary, and David Streeter, Mary’s son and Finley’s stepson, were present.

Mary and David were taken to the Mineral County Sheriff’s Office and interviewed. 

According to their statements, there a physical altercation took place between Mary and Jack.  During this altercation, Mary received numerous bruises and other injuries.  After the altercation, Jack called David, who was in Missoula with his family, and asked him to come to his and Mary’s residence in DeBorgia. 

David then dropped his family at their home approximately twenty miles west of Missoula and continued on to Jack and Mary’s residence.

When David arrived, he, Mary and Jack talked about the prior incident between Jack and Mary.  They told officers that Jack’s mood fluctuated between calm and very angry.  At one point, Jack walked to the back of the residence and returned a moment later with a shotgun in his hands.  He began to make threats about killing David and Mary, as well as about killing himself.  As Jack was making these threats, he was swinging the shotgun around and knocking items off of the counters.  When he pointed the shotgun at David, David drew his pistol and fired one round at Jack, striking him in the upper chest.  Jack dropped the shotgun and fell to the ground.

Immediately after firing the shot, David called 911 and began attempts to resuscitate Jack.  David continued to perform CPR on Jack until he was too exhausted to continue.  Officers and ambulance personnel arrived a short time later.

During the investigation, both firearms involved were recovered from the residence.  The shotgun that Jack had in his hands was found to have one live round in the chamber and the safety in the ‘fire’ position.  The injury that Jack received and the physical evidence collected was consistent with the statements that were given by both David and Mary.

Both Jack Finley and David Streeter had concealed weapon permits, and it was not uncommon for David to carry a pistol on his person. 

No charges have been filed against David Streeter related to this incident. 

The investigation was completed by the Mineral County Sheriff’s Office in consultation with the Montana State Department of Criminal Investigation in a manner consistent with Montana law regarding justified use of force as previously enacted by the Montana Legislature.
