Third defendant sentenced for Subway burglary

THOMPSON FALS – The third defendant in a case regarding the burglary of the Subway in Plains was sentenced on April 8.

According to court documents, Kailee Marie Salter was sentenced in accordance with a plea agreement.

On count one, burglary, a felony; Salter was sentenced to a three year deferred sentence, 60 days in the Sanders County Jail served by December 31, 2014, with credit of 29 days already served by the defendant.

Count two, tampering with a witness, and count three, obstructing a peace officer or other public servant were dismissed.

Salter’s sentencing followed that of Devin Ray Hendry-Callis’ sentencing which took place on March 25. Hendry-Callis was also sentenced in accordance to a plea agreement for burglary and received a three year deferred sentence, 60 days in the Sanders County Jail with credit for time served from October 16, 2013 to November 20, 2013, with the remainder of time to be served upon sentencing.

He was also sentenced for tampering with a witness, a felony, and received a three year deferred sentence, 60 days in the Sanders County Jail with credit for time served, and 60 days to be served upon sentencing. The counts were to run concurrently.

The court documents stated that the remainder of the unserved jail time could be either deferred or suspended if the defendant was able to enter the Job Corps. This would be conditional upon the outcome of the defendant’s performance at Job Corps.

The third person involved in the robbery, was sentenced on February 18. For the burglary, Dyllon Lee Totty-Hendry was sentenced to a three year deferred sentence, restitution of $760.34 paid to the victim and 60 days in the Sanders County Jail with credit for October 16, 2013 to December 10, 2013 served.

After completing the remainder of his time, Totty-Hendry was placed on supervised probation for three years.

The final sentencings closed the case in the burglary that occurred on Wednesday, October 2, 2013 where the Subway’s window was broken and $248 was taken.
