DNRC reminder: Water right needed for dust-abatement and road construction

SANDERS COUNTY – With road construction season in full swing, the Montana Department of Natural Resources and Conservation (DNRC) would like to remind contractors and project managers of the guidelines for acquiring water they might need for dust abatement and road construction.

“If your use of water does not fall under an existing water right – such as a municipal water right – you’ll need to make arrangements for a short-term lease of an existing water right,” said Tim Davis, Water Resources Division Administrator with DNRC.

State regulations allow for short-term water leasing – not to exceed 90 days -- without DNRC approval, but a lease agreement and a few basic steps for public notice are still required.

“In most cases, a 30-day public notice is necessary prior to using the water,” Davis said, “and notice to DNRC is required in all cases.”

The process is quick and easy, and following the rules will help reduce the number of complaints fielded by DNRC staff.
