NOTICE FOR PUBLIC HEARING The Mineral County Commissioners will hold a public hearing on June 23, 2023 at 11:00 A.M. in the Commissioner’s Meeting Room at 300 River Street, Superior, MT 59872, in conjunction with Mineral County Economic Development Corporation (MCEDC) and Mission West Community Development Partners (MWCDP) for the purpose of obtaining public comments regarding the overall community development needs and priorities existing in Mineral County for public and community facilities, infrastructure, affordable housing, economic development and community revitalization, and particularly as those needs affect low and moderate income persons and households. For those municipalities, sewer and/or water districts, and organizations considering applications for funding to the Montana Community Development Block Grant Program, this hearing may serve as the required “first public hearing” to assess and document overall community development and project needs. The Mineral County Commissioners may utilize the feedback received at this hearing to prioritize projects that may need their support and consideration. Information will also be used by MCEDC and MWCDP in their efforts to record needs as voiced by the public for input into a regional 5-year Economic Development Strategic Plan, which includes Mineral and Sanders Counties. Access to various funding programs available for public and community facilities, infrastructure, affordable housing and economic development will be discussed, including, but not limited to, the Community Development Block Grant (CDBG) program. At the public hearing, everyone will be given the opportunity to express their opinions regarding Mineral County’s community development needs and the types of projects that should be considered. Comments may be given orally at the hearing or submitted in writing before 5 p.m. on June 21, 2023, and will be read into the record at the public hearing. PUBLICATION OF NOTICE OF PENDING ATTACHMENT OF A TAX LIEN On Tuesday, August 1, 2023, the Mineral County Treasurer will attach a property tax lien to property on which the 2022 taxes are delinquent. The delinquent taxes, including penalties, interest and costs are a lien upon the property and that unless delinquent taxes, penalties, interest, and costs are paid prior to July 31, 2023 a tax lien will be attached and may be assigned to a third party. MCA 15-17-122 A complete delinquent list of all persons and property in the county now owing taxes, including all city and town property that is delinquent is on file in the office of the Mineral County Treasurer and is open to public inspection and examination. June 13, 2023 FINDING OF NO SIGNIFICANT IMPACT TO ALL INTERESTED GOVERNMENTAL AGENCIES AND PUBLIC GROUPS As required by state and federal rules for determining whether an Environmental Impact Statement is necessary, an environmental review has been performed on the proposed action below: Project St. Regis Sewer District Sewer Force Main Replacement Location St. Regis, Montana Project Number C302272 Total Cost $1,415,116 On January 11, 2019 the operator for the St. Regis Sewer District (SRSD) found a leak in the existing 6-inch PVC and DIP sewer force main beneath the Clark Fork River. The leak itself was spotted pooling up raw sewage in the Clark Fork River in St. Regis near the St. Regis Fishing Access Site. Shortly after the leak in the force main was detected, the District worked with DEQ and a contractor to perform an emergency repair to return the force main to service. Record drawings for the existing force main indicate that it was installed approximately 3 feet below the bed of the river. During repair it was found that an approximately 80-foot section of the force main is elevated above the bed of the river, making it susceptible to further damage. The sewer force main conveys wastewater from a majority of the district’s sewer users on the west side of the river to the sewer district’s wastewater treatment facility on the east side of the river. Disruptions to service from future breaks would result in significant impacts to the environment and public health and safety. The SRSD contracted with an engineering consulting firm in January of 2022 to complete an American Rescue Plan Act (ARPA) application and Technical Memorandum to evaluate alternatives to repair or replace the existing sewer force main and design a long-term solution. Through the analysis, it was determined that the preferred alternative would be to install a new sewer force main approximately 30 feet beneath the bed of the river using horizontal directional drilling techniques. As a result of this project, the reliability and integrity of the force main river crossing will be improved, thereby protecting against future incidents of pipe failure and resulting Clark Fork River contamination. Federal and State grant/loan programs will fund the project. Environmentally sensitive characteristics such as wetlands, floodplains, threatened or endangered species, and historical sites are not expected to be adversely impacted because of the proposed project. Additional environmental impacts related to land use, water quality, air quality, public health, energy, noise, and growth were also assessed. Public participation during the planning process demonstrated support for the selected alternative. No significant long-term environmental impacts were identified. Comments must be postmarked no later than 30 days after the publication date of this FONSI in the newspaper. After evaluating comments received, the department will revise the EA or determine if an environmental impact statement is necessary. If no substantive comments are received during the comment period, or if substantive comments are received and evaluated and the environmental impacts are still determined to be non-significant, this FONSI will stand.
