Ehlers III, versus all persons claiming any interest in or lien upon the real property described in this Summons or any part of the real property, Defendants. The State of Montana sends greetings to all persons claiming any interest in or lien upon the real property described in this summons or any part of that real property. You are required to appear and answer the complaint of Plaintiff, filed with the clerk of this court, within 60 days after the first publication of this summons, and set forth what interest or lien, if any, you have in or upon that certain real property or any part of the real property situated in the county of Mineral, State of Montana, particularly described as follows: The Northwest quarter of Section 28, Township 14 North, Range 24 West, P.M.M., Mineral County, Montana hereinafter, the “Property.” You are further notified that, unless you appear and answer, the Plaintiff will apply to the court for the relief demanded in the complaint, specifically that, without limitation, the Court:   Quiet title to the Property in the names of Plaintiff Harry C. Ehlers III and Defendant James Tuley as tenants in common owning equal, undivided interests in the Property;  Declare and set forth that all other defendants, and any person or entity claiming by, through or under them, have no other right, title, estate or interest in or to, or any lien or encumbrance upon, the foregoing interests in the Property; Declare that the title of the Property be established and quieted in the names of the persons named in paragraph A, above; and those persons be adjudged and decreed to be the absolute and unqualified owners of the Property as specified in paragraph A, above;  Declare that all defendants, and all other persons, unknown or known, claiming or who might claim any right, title, estate or interest in or lien or encumbrance upon the Property that is adverse to the ownership specified in paragraph A, above, or a cloud upon said title, whether such claim or possible claim be present or contingent, and any person or entity that may claim by, through, or under named or unnamed defendants, be forever barred and enjoined from asserting any right, title, estate, interest, or claim in and to, or lien or encumbrances upon the title provided in paragraph A, above;  Award reasonable attorney fees and costs to the extent provided by law; and  Grant such other and further relief as may be just and equitable. AUDIT PUBLICATION STATEMENT An audit of the affairs of the Town of Plains, Plains MT has been conducted by Denning & Downey and Associated, CPA’s, PC. The Audit covered in the fiscal year 2022-2023 ended June 31, 2023. Section 2-7-521, MCA, Required that this publication concerning the audit report include a statement that the audit report is on file in its entirety and open to public inspection at City Hall, and that the Town of Plains will send a copy of the audit report to any interested upon request.
